Town Planning Investigations

Within the City of Frankston, Councils Planning Investigations Officers are responsible for investigating non compliance of the Frankston Planning Scheme, Section 173 Agreements, conditions of planning permits issued by Council and the monitoring of all use and development on private and public land.

Examples of issues that can be investigated include:

  • Non compliance with approved planning permits and plans 
  • Vegetation Removal 
  • Home Occupation
  • Use and development of land
  • Satellite Dish Installation
  • Signage

Planning Investigations Officers have a number of enforcement options available to them to ensure appropriate compliance is achieved and depending on the nature and seriousness of the offence; can undertake one or more of the following enforcement actions:

  • Negotiate a resolution
  • Issue an official warning
  • Serve a planning infringement notice (on the spot fine) - usually for less serious breaches or matters
  • Prosecution of the offence in the Magistrate's Court (maximum fine exceeds $140,184.00) including payment of Council's legal costs
  • Apply to the Victorian Civil and Administrative Tribunal  (VCAT) for an enforcement order
