Frankston City Council receives many complaints about open air burning in the municipality and this is regulated by Local Law No.7, which incorporates a clause relating to open air burning for all residents to enjoy a healthy environment.

No person may light or allow to remain alight a fire in the open air unlessa permit to burn has first been obtained from the Fire Prevention Officer for the purpose of fuel reduction or fire hazard clearance.
The owner, occupier and person in charge of land on which there is a fire in contravention of the Local Law must immediately upon becoming aware of such fire, take all steps necessary to make it safe and completely extinguish the fire.
A person must not light, or allow to remain alight a fire, in a public place unless authorised to do so by a public body for the purpose of undertaking fire protection measures.
Barbecues are permitted for the purpose of cooking food.
Nuisance and Prohibition of Burning
No person may burn any substance in the open air on any land (or road, etc.) in such a manner as to cause a nuisance or be injurious or offensive.
Fires cannot be lit in incinerators at any time within the municipality of Frankston.
No barbecue may be lit on a total fire ban day unless it is being used for the sole purpose of meal preparation and is fired by gas or electricity and is within 20 metres of a dwelling.
