Planning Infringements

Frankston City Council is committed to providing a safe environment for its residents and visitors.  Laws under the Planning and Environment Act deal mainly with how land is used or developed.  Other things that are sometimes controlled by Planning legislation is the removal or cutting of vegetation in areas where there are Planning Overlays to protect vegetation

Planning infringements are a way of enforcing the planning laws and regulations that govern the use and development of land in Victoria.  They determine what is appropriate in an area depending upon the Zone of the land and a number of other factors.  For example, it might be appropriate to open a home based hairdressing salon in a Residential Zone but a home based panel repair shop would not usually be allowed in such an area.  Planning infringements may also require the offender to take additional steps to remedy the situation, such as stopping, modifying or removing the development that constituted the offence.  

Planning infringements are an alternative to more formal and costly enforcement actions, such as enforcement orders, prosecution or injunctions. However, if a planning infringement is not paid or disputed within the specified time, or if the additional steps are not taken, Council may pursue further enforcement action.
