Apply for an Occupancy Permit for a POPE and Temporary Structures

You may need an Occupancy Permit for a Place of Public Entertainment (POPE) and/or approval for siting of Temporary Structures application.

An Occupancy Permit for a POPE is required for:

  • a building with a floor area greater than 500sq.m to be used or intended to be used for entertainment for which admission is charged or giving of other consideration; or
  • a place with an area greater than 500sq.m that is enclosed or substantially enclosed (e.g. fencing etc.) or charges an entrance fee or giving of other consideration.

Please note that Community Based organisations may be exempt from this requirement, these organisations should obtain written advice from a Council building surveyor. 

Approval for siting of prescribed Temporary Structures is required for:

  • a tent, marque or booth greater than 100sq.m
  • a prefabricated buildings exceeding 100sq.m other than ones placed directly on ground 
  • seating stands for more than 20 persons 
  • stages or platforms (including Sky Borders & Stage Wings) greater than 150m2

Step 1.Check if you need other approvals

It is your responsibility to notify the Owner and Event Manager of any other approvals you may need. This may include approvals or permits related to:

  • events
  • planning
  • parks and infrastructure
  • local laws
  • health, compliance and safety.

Step 2.Prepare your application

Your application must include:

  • A recent copy of the Certificate of Title and Plan of Subdivision, including any restrictions such as a Section 173 Agreement. You can obtain a Certificate of Title from the Landata website.
  • Copy of approved occupancy permit from the VBA.
  • Written consent from the owner for proposed use of the land.
  • Details of the event including a Site Plan, Emergency Evacuation Plan and Essential Safety Measures (ESM's).
  • Copy of valid public indemnity insurance (Certificate of Currency).
  • Copy of approved structural plans, computations and certification from a registered Structural Engineer.

Approval is required before occupation and the siting of structures.

In most circumstances, the owner/applicant will need to engage a Victorian registered practitioner in the category of ‘engineer, erector of temporary structures’ to carryout an onsite inspections and to certify all temporary structures associated with the event. This appointment should be made prior to finalising the scheduling of the event to avoid the structure being prohibited from use.
