Do I need a permit to change the use of my land?

A planning permit is generally required for a change of use application.

A change of use includes proposals such as offices, shops, restaurants, gymnasiums. A change of use application may also require a variation to the car parking provisions of Clause 52.06 of the Frankston Planning Scheme. Contact the Statutory Planning Department on 1300 322 322 to discuss further.

How do I submit an application?

Many applicants engage a planning consultant to put together an application given the complexities in navigating the various planning controls which may apply to the land, as well as the potential of receiving objections, however this is not mandatory. Your consultant may wish to meet with Council’s Statutory Planners for a Pre-application Meeting prior to lodging an application.

In your application you will need to include:

  • A full set of plans detailing the use of the proposed site would be required to be submitted.
  • A written report or cover letter detailing the proposed use, including patron and staff numbers and hours of operations.
  • Details of security measures, noise impacts such as music, acoustic measures and any other information which may provide details as to the proposed use and its impacts on neighbouring sites.

Depending on the proposed use you may be required to provide a traffic report, car parking assessment or a management plan. In this case it would be advised to engage the services of a planning professional.
