Amend or end a Section 173 Agreement

Section 177 and Section 178 of the Planning and Environment Act 1987 (Vic) outlines how you can amend or end a Section 173 Agreement. 

One method is by obtaining written consent of all parties. However, this can take time and may be difficult to achieve if there is opposition or many parties involved. 

If this is not possible, you can apply to amend or end a Section 173 Agreement with Council, and have it removed from the land title.

Step 1.Prepare your application

Your application must include:

  • A complete copy of the Certificate of Title that is no older than 3 months, including any restrictions such as a Section 173 Agreement. You can obtain a Certificate of Title from the Landata website.
  • Details of the Section 173 Agreement.
  • Details of the proposed amendment.

Step 2.Download the application form

Download and complete the Application to Amend or End a Section 173 Agreement(DOCX, 770KB)  form.

Step 3.Submit your application

Send your completed form and supporting documents to:

Step 4.What happens next?

We will contact you to pay the relevant fee.

Your application may be referred to Council's solicitors depending on the complexity of your proposal. You will be responsible for covering the cost of public notification in addition to the application fee.
