Request a Section 173 Agreement

As part of your planning permit application, we may request a Section 173 Agreement.

A Section 173 Agreement is a legal contract made between Council and another party, or parties, under Section 173 of the Planning and Environment Act 1987 (Vic). The agreement outlines restrictions or requirements on the use or development of land.

A landowner is usually the other part to the Agreement. In some cases, a third party such as a referral authority may also be involved.

Step 1.Prepare your application

Your application must include:

  • A complete copy of the Certificate of Title that is no older than 3 months, including any restrictions such as a Section 173 Agreement. You can obtain a Certificate of Title from the Landata website.

We will contact you to pay the relevant fee, which covers Council’s administrative costs. 

An additional fee is payable to Council’s solicitors who will prepare the agreement. They will contact you directly for payment.
