Apply for a corner fence dispensation

If you plan to build a fence on a corner property, you may need consent before commencing work. This is usually required before submitting a building permit application.

You will need to apply for consent if the corner fence is:

  • more than 1m high above the footpath
  • and located within 9m of the property boundary lines.

It is your responsibility to check any requirements you may need to meet when building a fence. If consent is not required, you may need other approvals such as a planning permit. Visit our Fences page for more information.

Step 1.Check for restrictions

Before preparing your application, check if there are any restrictions that may impact your proposal. This may include a covenant or section 173 agreement listed in the Certificate of Title. You can obtain a Certificate of Title from the Landata website.

Step 2.Talk to your neighbours

If your fence will be more 1.5m high, you will need to get approval from your neighbours and submit a signed Adjoining Owners Comment form(PDF, 328KB)  with your application.

If you are unable to locate contact details, you can submit a request for ownership details for fencing purposes.

Step 3.Prepare your application

Your application must include:

  • your contact details
  • property address
  • architectural plans
  • a copy of the Certificate of Title
  • details of proposed works including fence height, footing details and materials
  • a signed copy of Adjoining Owners Comment form (if required).

Step 4.Download the application form

Download and complete the Corner Fence Dispensation application form(PDF, 156KB).

Step 5.Submit your application

Send your completed form and supporting documents to:

info@frankston.vic.gov.au

Step 6.What happens next? 

We will contact you to pay the fee.

We will process your application within 15 business days.

Building work must not commence until your permit has been issued.
