Apply to build over an easement

If you plan to build a structure over an easement, you will need to apply for consent before commencing work. This ensures we are still able to access drainage located underneath the easement.

An easement is generally located at the rear or down the side of a property and may contain:

  • a Council or Melbourne Water drain
  • a South East Water sewer main
  • electricity supply or gas main
  • space reserved for future drain, sewer or utilities supply.

You can check if there is an easement on your property by requesting a copy of the Certificate of Title from the Landata website.

Depending on the type of easement, building may not be permitted as access to the buried pipes may be required for maintenance or renewal. You can not build habitable structures over an easement.
