Planning Scheme amendment process

Overview

The Frankston Planning Scheme sets out policies and requirements for the use, development and protection of land within Frankston City Council.

At times, changes are made to the Planning Scheme. These changes are called a Planning Scheme amendment.

Who can prepare or amend the Planning Scheme?

An amendment can be prepared by any planning authority specified in the Planning and Environment Act 1987 (Vic). This may include:

  • a local council
  • the Minister for Planning
  • a minister or government agency that has been authorised by the Minister for Planning.

Individuals and other parties can request an amendment to the planning scheme. To be considered, the request must:

  • be in writing
  • be consistent with the strategic vision for the municipality
  • demonstrate merit and adequate justification why the amendment should be prepared.

Authorisation

If we receive a request to amend the planning scheme, we will assess whether the proposal has merit to proceed.

If we decide to progress, we must apply to the Minister for Planning for authorisation to prepare an amendment.

The purpose of authorisation is to identify whether a proposed amendment is consistent with state policy or interests and to ensure it makes appropriate use of the Victorian Planning Provisions.


Exhibition

If a request is authorised by the Minister for Planning, it will be made available for public consultation. This stage of the amendment process is called Exhibition.

Anyone can lodge a submission to support, oppose or suggest changes to the amendment. All submissions should be lodged before the closing date of the exhibition. This will allow the opportunity to present your view to a panel, if a panel is appointed to consider the submissions.

Panel Hearing

An independent panel may be appointed by the Minister for Planning to consider the submissions and the amendment. The Panel:

  • reviews the submissions
  • conducts a public hearing
  • considers the amendment
  • prepares an independent report with recommendations about the amendment for Council.

After the panel hearing, the Panel has 6 to 8 weeks to provide a report to Council with its recommendations on the amendment. Council has no obligation to adopt the panel's recommendations.


Approval

Once an amendment has been adopted by Council, it is submitted to the Minister for Planning for final approval. After approval, it becomes a part of the Frankston Planning Scheme.

The Department of Environment, Land, Water and Planning (DELWP) website has a list of approved Frankston Planning Scheme Amendments.


Amendment fees

There are fees for requesting a planning scheme amendment.  

The proponent is also responsible for covering all costs associated with the administration of the planning scheme amendment. This may include:

  • advertising in the newspapers
  • advertising in the Government Gazette
  • public notification
  • expenses incurred by a panel (if appointed).

The cost of the Panel will depend on the length of the review and number of members appointed.
