Footpath Trading and Parklet Permit

A permit is required to place tables, chairs, signs or goods on the footpath as part of your hospitality or retail operations.

Frankston City Council supports footpath trading for local businesses as it supports economic outcomes and adds to the atmosphere of our shopping and dining precincts. However, Council also needs to keep people who use footpaths safe.

What can I place on the footpath?

Items used for Outdoor Dining and Trading activities include:

  • display of goods
  • outdoor dining (including tables, chairs, umbrellas, screens, awnings, outdoor gas heaters)
  • planter boxes
  • temporary signage (including A-frame signs)

Eligibility

Please note: each site is subject to individual assessment, based on context, amenity, urban design & traffic outcomes, safety and overall contribution to the street.

Footpath Trading and Parklets are not intended to privatise the public realm. Any proposal which fully encloses outdoor dining or creates visual and physical privatisation of the public realm will not be approved.

Hospitality and retail operators may apply for a Footpath Trading permit, immediately in front of their premises, and/or in front of an adjoining premise with written approval from their neighbouring business operator.

Fees

Footpath Trading

  • Outdoor dining and trading fees are calculated per square metre of the space occupied by items, not the entire trading area.
  • Businesses can display their goods for 12 months with an annual permit and can choose an Outdoor Dining permit for either a 6 or 12 month period. 
  • Annual permits are from 1st July to 30th June (quarterly pro-rata fees apply from permit commencement date)
  • Six month permits are from 1st  October to 31st March (pro-rata fees apply from the permit commencement date).

Step 1.Prepare your application

Your application must include: 

  • Business details and location
  • Applicant contact details
  • Proposed design layout including trading furniture or signage
  • Site plan
  • Certificate of Public Liability Insurance with minimum of $10M cover for A -frames and $20M cover for outdoor dining, display of goods and Parklets and noting Frankston City Council as an interested party
  • Written neighbouring property consent, if applicable.

Step 3.What happens next?

  • Council officers conduct a site visit to review the proposed trading area, if required
  • Council officers conduct a pedestrian and traffic safety assessment, if required*
  • Assessment of application completed by Council officers.
  • Receive notice of conditional approval and annual permit fee invoice.
  • Pay permit fee invoice.
  • Successful applicants will receive a Footpath Trading and/or Parklet permit which must be displayed clearly in the window of the permitted business premise at all times.
  • Permit conditions must be adhered to at all times.
