Amendment C157 – Elevating Environmentally Sustainable Development

Overview

Planning Scheme Amendment C157fran proposes to introduce a new planning control relating to Environmentally Sustainable Development (ESD) into the planning scheme. The planning control (called a particular provision) contains ESD objectives and standards which implement measures that facilitate best practice ESD and support new development which produce net-zero carbon emissions.

The ESD objectives and standards address:

  • Operational Energy (energy efficiency, performance and greenhouse gas emission reduction)
  • Embodied Carbon (greenhouse gas emission reduction and resource efficiency)
  • Sustainable Transport (electric vehicles and bicycles)
  • Integrated Water management (water efficiency and integration)
  • Green infrastructure (lot scale vegetation and urban ecology)
  • Climate resilience (climate change adaptation, urban heat mitigation)
  • Waste & Resource Recovery (recycling and waste management)

Under the proposed changes, new developments would:

  • Produce net zero carbon emissions.
  • Reduce household bills by making buildings more energy efficient.
  • Provide a healthier and more comfortable environment for building occupants.
  • Better manage water quality, use and collection.
  • Protect and enhance greening and biodiversity.
  • Be more resilient to changing climate impacts.

The particular provision identifies which types of residential and non-residential development must respond to the new objectives and standards when a planning permit is required. It also details the type of information that must be submitted to support permit applications.


Land Affected by the Amendment

The Amendment applies to all land within Frankston City Council. However, the particular provision will only affect certain types of new development that need a planning permit:

  • Residential development of two or more houses on a lot (excluding subdivision);
  • Buildings with a floor area of more than 50 square metres; and
  • Increasing the floor area of an existing buildings by more than 1000 square metres.

Examples of development that won’t be affected include:

  • Development that does not require a planning permit;
  • Development in a rural zone, most public land zones and the Low Density Residential Zone;
  • One house one a lot;
  • Developments associated with agriculture or earth and energy resources industry;
  • Increasing the floor area of an existing buildings by 1000 square metres or less; and
  • New buildings with a floor area less than 50 square metres. 

Next Steps

Council has sought authorisation from the Minister for Planning to prepare and exhibit Planning Scheme Amendment C157.

The request has been made simultaneously with 23 other Victorian councils seeking identical amendments to their own planning schemes as part of a combined project through the Council Alliance for a Sustainable Built Environment (CASBE).

If authorised, the Amendment will be placed on public exhibition. During exhibition, anyone can view documents free of charge and lodge a submission for Council’s consideration. Details of exhibition and how to make a submission will be released following authorisation by the Minister for Planning.
